Service Agreement (Please read carefully)

TERMS AND CONDITIONS OF SERVICE PROVIDED BY INTERNET DESIGNS General Internet Designs LLC exercises no control over the content of the information passing through the Net and takes no responsibility for the way in which its products are being used or affected by the Net. Internet Designs LLC also disclaims any warranty of merchantability or fitness for a particular purpose. Internet Designs LLC will make all necessary efforts to ensure the reliability of its products and services but is not responsible for any damage you may suffer through the use of such products or services. This includes loss of revenue resulting from programming errors, non-deliveries, mis-deliveries of orders, emails or any other information processed through the website and the related hosting service, or service interruptions, caused by its own negligence or your error. Internet Designs LLC makes no warranties of any kind, whether expressed or implied, for the services and products it is providing. Internet Designs LLC. offers a 100% warranty on all software issues (bugs) found in the first 30 days after end user approval of the application or web-site. All problems discovered outside of the warranty period can be fixed at our standard hourly rate. Internet Designs LLC specifically denies any responsibility for the Accuracy or Quality of information obtained through its services. Internet Designs LLC's products may only be used for lawful purposes. User agrees not to use any products of Internet Designs LLC in a manner that is inconsistent with any and all applicable laws. Billing Customer agrees to pay Internet Designs LLC all charges related to the Service(s) provided in a timely manner. Payment is due upon receipt of invoice. After 30 days of the original billing date a monthly late charge of 10% of the total outstanding invoice amount will be assessed for each following month if invoices remain unpaid. All unpaid invoice(s) will eventually be submitted to the care of a Collection Agency or a lawyer. Returned checks will be subject to a $25.00 fee. The remaining balance of the invoice total minus the down payment is due immediately after completion of project. If the project can not be completed in a timely manner because the customer fails to supply Internet Designs LLC with the necessary materials as in pictures, data and all other relevant information agreed upon in prior meetings, Internet Designs will bill the customer for work done up until this point. As soon as you sign this contract you are entering a business relationship with Internet Designs LLC. From this point on we reserve the right to charge you for all activities on your behalf as in preliminary research, telephone consultation and other efforts even if you should decide to cancel your order before the start of the actual design process. Any down payments will be forfeited after 6 months of receipt if customer does not facilitate the continuation of the design process before the 6 months deadline has been reached. Misc Internet Design LLC reserves the right to charge phone support in 15 minute increments based on our current hourly charge. (most phone conversations with our customers are free of charge). Warranties and Limitations. a) Except for material provided by Client or its consultants to the Consultant for incorporation into the Consultant work product, the Consultant warrants that it will have the appropriate right, title, and interest to the software development tools used, and the work product will not infringe any rights of third parties due to such software. b) The Consultant does not warrant that its designs or programming will be error free; however, the Consultant will use reasonable efforts to attempt to correct any reported design or programming errors as a service to be provided under this agreement. The Consultant shall have no liability for design decisions made wholly or in part by Client or any other consultant for Client. c) THERE ARE NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, AND NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ANY LIABILITY BY THE CONSULTANT TO CLIENT SHALL BE LIMITED TO AMOUNTS RECEIVED FROM CLIENT. THE CONSULTANT SHALL NOT BE LIABLE FOR ANY CLAIM OR DEMAND, EITHER DIRECTLY OR AS A RESULT OF A THIRD PARTY CLAIM AGAINST CLIENT, FOR LOST PROFITS, OR FOR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES. Limitation of Liability Internet Designs LLC's service is provided on an "as is" basis, no warranties, expressed or implied, including but not limited to those of merchantability of fitness for a particular purpose, are made with respect to Internet Designs LLC or any information or software therein. Neither Internet Designs LLC nor its information sources are responsible for any damages arising from User's use of Internet Designs LLC's products or by his or her inability to use said services or products. Internet Designs is not responsible for any information residing on any databases or any means of storage related or connected to the website including but not limited to personal information, financial information as in credit card numbers, bank information etc. Internet Designs is not responsible for any losses or injuries arising from the use of its products or services. Internet Designs will ensure to the best of its abilities that all designs will be cross-browser compatible, provided the customer/user has a newer version of these browsers installed on their computer(s). No guarantees are given in regards to the functionality on a MAC platform. In general very few compatibility problems will be found but based on the nature of the MAC platform and it's lack of harmonization with the PC platform Internet Designs LLC can not be held responsible for functionality issues/problems related to its products.

I have read and I understand the above Service Agreement and I hereby authorize Internet Designs to design a website for my company / organization and execute any additional task(s) outlined in this document. Furthermore I promise to pay the agreed upon amount in a timely manner.

I understand that the estimated cost of the project is only related to the work discussed up to this point. Any changes added at a later time or any additional details not specifically discussed during prior meetings will increase the cost of the project.
